718.111(1) (d) (HB 1237): Criminal Penalties

 

This update applies to condo associations

 

Forgery of a ballot envelope or voting certificate…theft or embezzlement of funds…the refusal to allow inspection or copying of an official record…are now deemed to be criminal activities.

 

This provision to current law subjects board members to criminal charges for the theft or embezzlement of funds of an association, forgery of a ballot envelope or voting certificate utilized in association elections, and the destruction of, or refusal to allow, inspection or copying of an official record of an association that is accessible to unit owners within the time periods required by general law.  Furthermore, an officer or director may not be appointed or elected to such positions if a criminal charge is pending against them.
